These Terms & Conditions (“Terms”) govern your use of nearmydoctor.com (the “Website”) and the call-back, enquiry and appointment-assistance services offered by NearMyDoctor (“we”, “us”, “our”) (together, the “Services”). By using the Services you agree to these Terms. If you do not agree, please do not use the Website.

1. What NearMyDoctor does

NearMyDoctor is an information and appointment-assistance platform. We publish information about doctors, diagnostic centres, hospitals, treatments and indicative prices, and we help patients contact healthcare providers. We are not a hospital, clinic, laboratory, pharmacy or insurer, and we do not employ the doctors or providers listed on the Website.

2. Not medical advice

All content on the Website is for general information only and is not a substitute for professional medical advice, diagnosis or treatment. Always consult a qualified, registered medical practitioner about your health. Never ignore professional medical advice or delay seeking it because of something you read on the Website.

In a medical emergency, call 108 or go to the nearest hospital emergency department immediately. Do not use the Website or wait for a call back in an emergency.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract under Indian law to use the Services. A parent or lawful guardian may use the Services on behalf of a minor or another person in their care, and is responsible for the information they provide.

4. Enquiries and appointments

• Submitting a form is a request for a call back. It is not a confirmed appointment, admission or booking until the provider confirms it.
• We try to respond during our working hours (Mon–Sat, 8 am – 9 pm), but response times are not guaranteed.
• Availability, waiting times, doctors on duty and appointment slots are decided by the provider and may change without notice.
• You agree to give accurate information, including a mobile number that belongs to you or that you are authorised to use.

5. Prices and payments

• Our service is free for patients. We do not charge patients for enquiries, call backs or appointment help.
• Prices shown on the Website are indicative ranges based on published rates and information from providers. The final amount is set by the provider and depends on your medical needs, the doctor, the room category, consumables, tests and your insurance cover.
• You pay the provider directly. Any payment, refund, billing or insurance dispute is between you and the provider.
• Information about RGHS, Ayushman Bharat or private insurance is a general guide only. Coverage is decided by the scheme or insurer and the provider.

6. Providers and listings

Doctors, hospitals and diagnostic centres listed on the Website are independent of NearMyDoctor. Listing information is compiled from public sources and from providers themselves. We take reasonable care, but we do not guarantee that it is complete, current or accurate, and a listing is not an endorsement or a recommendation of a provider's clinical quality.

NearMyDoctor has no control over, and is not responsible for, the medical advice, diagnosis, treatment, conduct or outcomes of any provider. Any treatment you receive is solely between you and the provider.

How we are paid: some providers pay us a fee for enquiries we introduce, or a subscription to be listed. This does not change the price you pay the provider.

7. Terms for providers

• If you submit a “List your practice” or “Claim your listing” request, you confirm that you are the provider or are authorised to act for them. We may verify claims by phone or documents before granting access or making changes.
• Providers must hold all registrations and licences required by law and must keep the information they give us accurate.
• Providers who receive patient details from us must use them only to respond to that patient's request, keep them confidential, and comply with applicable data protection law.
• We may correct, suspend or remove any listing that is inaccurate or misleading, or that breaches these Terms or the law. Paid plans, if any, are governed by a separate agreement.

8. Acceptable use

You agree not to:

• submit false, misleading or someone else's information, or impersonate any person or provider;
• send spam or automated submissions, or interfere with the Website's security or operation;
• copy, scrape or reproduce the Website's content or listings for commercial use without our written permission;
• use the Services for any unlawful purpose, or to harass or harm any patient, provider or our staff.

9. Intellectual property

The Website's design, text, graphics, logos and the NearMyDoctor name are owned by or licensed to NearMyDoctor and are protected by law. You may view and share pages for personal, non-commercial use. Provider names and trademarks belong to their respective owners.

10. Disclaimer of warranties

The Website and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including about the accuracy of listings or prices, the availability of any provider, or that the Website will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, NearMyDoctor is not liable for any indirect, incidental, special or consequential loss, or for any loss arising from the acts, omissions, medical advice, treatment or charges of any provider. Because our service to patients is free, our total liability to you for any claim relating to the Services is limited to ₹1,000. Nothing in these Terms limits liability that cannot be limited under Indian law.

12. Indemnity

You agree to indemnify NearMyDoctor against any claims, losses or costs arising from your breach of these Terms, your misuse of the Services, or information you submit that is false or that you were not entitled to share.

13. Privacy

Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

14. Changes to the Services and these Terms

We may change, suspend or discontinue any part of the Services at any time. We may also update these Terms; the “Last updated” date shows when they last changed. Continuing to use the Services after an update means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer protection law, the courts at Jodhpur, Rajasthan have exclusive jurisdiction over any dispute arising from these Terms or the Services. Before going to court, please contact us so we can try to resolve the matter informally.

16. Grievances and contact

For questions or complaints about the Services, contact our Grievance Officer at info@nearmydoctor.com or through our contact page. We acknowledge complaints within 48 hours and aim to resolve them within 30 days.
