This Privacy Policy explains how NearMyDoctor (“NearMyDoctor”, “we”, “us” or “our”) collects, uses, shares and protects personal data when you use nearmydoctor.com (the “Website”) and our related call-back and appointment-assistance services (together, the “Services”).
We process personal data in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the Information Technology Act, 2000 and the rules made under them. By using the Services or submitting a form, you agree to the processing described in this policy.
1. Who we are
NearMyDoctor is an online platform that helps people in Jodhpur and other cities in Rajasthan find and contact doctors, diagnostic centres and hospitals. For the purposes of the DPDP Act, NearMyDoctor is the “Data Fiduciary” for the personal data described in this policy. You can reach us at info@nearmydoctor.com.
NearMyDoctor is not a hospital, clinic or healthcare provider and does not provide medical advice, diagnosis or treatment.
2. Personal data we collect
Information you give us
- Enquiry and appointment forms: your mobile number (required), and optionally your name, the service, doctor or facility you are interested in, your preferred time to be called, whether you have RGHS or health insurance, and any message you choose to write.
- Provider forms (“List your practice” and “Claim your listing”): the practice or facility name, contact person's name and role, mobile number, city and plan of interest.
- Communications: details you share when you call, WhatsApp or email us.
Please do not send medical reports, prescriptions, test results or other detailed health records through the Website. If you share health information in a message, we use it only to help with your request.
Information collected automatically
- Page and action data: the page from which you submitted a form, and a record when you tap a call or WhatsApp button (the type of button, the page and the time). This tap record does not include your phone number or name.
- Technical data: your IP address and basic browser information, which our hosting provider processes to deliver the Website and which we use, for a short time, to prevent spam and abuse (for example, by limiting how many forms can be sent from one address).
Cookies
The public Website does not use advertising or third-party tracking cookies. We use one strictly necessary cookie to keep authorised staff signed in to our internal admin area. Your browser may also store basic settings locally.
3. Why we use your data
We use personal data only for the following purposes:
- To call, message or WhatsApp you about the enquiry or appointment you requested.
- To share your enquiry with the doctor, hospital or diagnostic centre you selected, or one that fits your request, so they can arrange your consultation, test or admission.
- To check whether your RGHS or insurance scheme is likely to be accepted, when you ask us to.
- To verify and manage provider listings and listing claims.
- To keep records of enquiries, follow up, resolve complaints and improve the Services.
- To keep the Website secure and prevent fraud, spam and misuse.
- To comply with applicable law and respond to lawful requests from authorities.
We do not sell your personal data, and we do not use it for advertising or for marketing unrelated to your request.
4. Legal basis
We process your personal data on the basis of your consent, which you give when you submit a form or contact us, and for legitimate uses permitted under the DPDP Act, such as complying with law, preventing fraud, and responding to medical emergencies. You may withdraw consent at any time (see section 8). Withdrawal does not affect processing carried out before it.
5. Who we share data with
- Healthcare providers: the hospital, clinic, doctor or diagnostic centre relevant to your request receives your name, mobile number and the details of your request. Each provider is independently responsible for how it handles your data once received.
- Service providers (Data Processors) who help us run the Services under contract and only on our instructions:
- Supabase, which stores enquiry records in a database hosted in Mumbai, India;
- Vercel, which hosts the Website and processes technical request data;
- communication services such as telephone and WhatsApp, when we contact you.
- Authorities: when required by law, court order or a lawful government request, or to protect the rights, safety or property of our users, providers or the public.
- Business transfers: if NearMyDoctor is reorganised, merged or sold, personal data may be transferred to the successor, which will be bound by this policy.
6. Where your data is stored
Enquiry records are stored in India. Some of our service providers may process technical data on servers outside India. Any such transfer is made in accordance with the DPDP Act and any restrictions notified by the Government of India.
7. How long we keep it
We keep enquiry and contact records for up to 12 months after your last interaction with us, and provider records for as long as the listing is active and for 12 months afterwards. We then delete or anonymise them, unless a longer period is required by law or needed to resolve a dispute. Tap records and anti-spam data are kept for a shorter period.
8. Your rights
Under the DPDP Act you have the right to:
- obtain a summary of the personal data we hold about you and how we use it;
- ask us to correct, complete or update inaccurate or incomplete data;
- ask us to erase your data, where it is no longer needed or you withdraw consent;
- withdraw your consent at any time;
- nominate another person to exercise your rights in the event of your death or incapacity; and
- raise a grievance with us, and, if unresolved, with the Data Protection Board of India.
To exercise any of these rights, email info@nearmydoctor.com or use our contact page, mentioning the mobile number you used. We may need to verify your identity before acting on a request. We aim to respond within 7 working days and in any case within the time required by law.
9. Security
We use reasonable security safeguards appropriate to the data we hold, including encrypted connections (HTTPS) for the entire Website, a database that is not publicly accessible, access restricted to authorised staff through password-protected accounts, and limits that block automated spam. No system is completely secure, but if a personal data breach occurs we will notify affected users and the Data Protection Board as required by law.
10. Children
The Services are intended for adults. If you are under 18, please ask a parent or guardian to contact us on your behalf. Where an enquiry relates to a child, it should be submitted by the parent or lawful guardian, whose consent we rely on. We do not knowingly track or target advertising at children.
11. Links to other websites
The Website may link to other websites and to services such as WhatsApp. Their privacy practices are their own, and we encourage you to read their policies.
12. Changes to this policy
We may update this policy from time to time. The “Last updated” date at the top shows when it was last changed. If we make significant changes, we will highlight them on the Website.
